At Indigo Server Hosting (ISH), we are committed to providing secure, reliable, and lawful hosting services. This Acceptable Use Policy (AUP) outlines the acceptable uses of our services, the security measures in place, and the consequences of violations. By using our services, you agree to comply with the terms set out below.

1. Security Measures and Infrastructure

a. Hardware and Protection:

  • Our infrastructure is powered by Unifi hardware, which provides enterprise-level networking capabilities and security features. This ensures a stable and secure environment for hosting services.
  • We offer protection against attacks up to 2.5 Gbps continuous (DDoS and similar threats). However, protection against larger or more sophisticated attacks cannot be guaranteed.

b. Self-Destructive Databases:

  • Our databases are configured with a self-destructive mechanism. If a breach or unauthorized access attempt is detected, the databases will automatically wipe themselves to prevent data theft.

c. IP Address Wiping:

  • To ensure privacy and security, we wipe IP address logs every 15 minutes. This helps minimize the retention of potentially identifiable information.

2. Client Responsibilities and Data Compliance

a. GDPR Compliance (Client-Side):

  • We do not store sensitive personal data such as addresses, IP addresses or most contact information. However, clients are responsible for ensuring compliance with the General Data Protection Regulation (GDPR) or other applicable data protection laws when storing and processing personal data on their hosted services.
  • Clients (the Hostee) are fully responsible for ensuring that personal data stored or processed through our hosting services complies with all applicable regulations. This includes but is not limited to email addresses, IP addresses, and other personal identifiers.

b. Consequences of Non-Compliance:

  • Failure to comply with GDPR or similar laws may result in service termination. Clients are responsible for implementing appropriate security measures to protect personal data hosted on our services.

3. Permitted and Prohibited Use of Services

a. Authorized Use:

  • Our hosting services are to be used only in ways that were clearly stated at the time of purchase and are consistent with the nature of our services. You may not use our services in any way that violates the law or infringes on the rights of others.
  • The services provided by Indigo Server Hosting must be used for lawful purposes only. This includes, but is not limited to, hosting websites, applications, and game servers that comply with all applicable local, national, and international laws.

b. Prohibited Use – Illegal Content and Activities:

  • ANY illegal content or activities hosted on or through our services will NOT be tolerated. This includes but is not limited to:
    • Child exploitation material or any form of illegal pornography.
    • Hacking, phishing, spamming, or any other fraudulent activities.
    • Malware, viruses, or other malicious software.
    • Copyright infringement, such as hosting pirated content or distributing unauthorized software, music, videos, or any intellectual property.
    • Terrorism-related content, including content promoting violence or extremism.
    • Hate speech, content that promotes racism, discrimination, or incites violence.
    • Fraudulent transactions or using the hosting service for illegal financial schemes.
    • Any content that violates the intellectual property rights of others, including using our hosting services to distribute pirated content or software.

c. Enforcement and Legal Actions:

  • If we become aware of any illegal content or activities being hosted on our services, we reserve the right to immediately suspend or terminate the offending account and services without notice.
  • Indigo Server Hosting may be required by law to report such violations to law enforcement authorities or national-level enforcement agencies. This may result in an investigation or legal action being taken against the client, including but not limited to:
    • Contacting local or international law enforcement agencies.
    • Suspending access to the services and providing all necessary evidence to authorities for prosecution.
    • Cooperating with government agencies and legal teams in the event of an investigation into illegal activities hosted on our platform.

4. Service Termination for Violations

If you are found to be in violation of this Acceptable Use Policy, we reserve the right to suspend or terminate your hosting services without notice. Violations may include but are not limited to:

  • Engaging in illegal activities as outlined above.
  • Attempting to harm or compromise the security of our infrastructure, networks, or other clients.
  • Failure to comply with applicable data protection laws (e.g., GDPR).

5. Limitation of Liability

While Indigo Server Hosting makes every reasonable effort to provide a secure and reliable service, we cannot guarantee that your hosted services will be immune from all attacks or breaches. Our liability for security incidents is limited to the protection measures and services we provide, and we are not responsible for damages resulting from external attacks, malicious activities, or client negligence in managing their hosted services.

6. Changes to the AUP

Indigo Server Hosting reserves the right to modify this Acceptable Use Policy at any time. Clients will be notified of any material changes, and continued use of our services will indicate acceptance of the updated terms.
